Comprehensive Foreign Manufacturing Certification Approval Process

What is FMCS Approval?

Bureau of Indian Standards (BIS), abbreviated as BIS, is the regulatory body under the Department of Ministry of Consumer Affairs, Foods and Public Distribution, governed by the Government of India. BIS grants licenses to products conforming to requirements specified under Indian Standard Specifications.

It ensures the quality conformance of products through specific categories mentioned as Indian Standard (IS Numbers). BIS Certification allows products to use the BIS Standard Mark (ISI Mark) as per specific Indian Standards.

BIS Certification under ISI Procedure is covered under Scheme-I of Schedule-IV of Bureau of Indian Standards

BIS certification ensures product quality and safety, providing manufacturers with a competitive edge in the market.

FMCS Certification Procedure

For the Manufacturing outside India, the process is categorized under Foreign Manufacturers’ Certification Scheme also termed as FMCS. This Certification process is administrated by Foreign Manufacturers’ Certification Department (FMCD) under Bureau of Indian Standards (BIS) headquartered at Manak Bhawan, New Delhi.

Process for the Inclusion of New Variety(ies)

Fresh Application(Grant of License)

  1. Nomination of an Authorised Indian Representative (AIR) who shall be the Permanent Resident of India. An AIR can represent only One Foreign Company. AIR can be any Branch Office in India/Liason Office in India/Importer Company/Any Individual who shall be responsible for the valid regulation of the License during the Operative Period of License
  2. Preparation of the documentation as per the requirement of BIS norms.
  3. Arrangement of the requisite areas as per BIS guidelines.
  4. Procurement of the In-House Testing Laboratory inside the Factory Premises
  5. Submission of the application through Hard Copy and is submitted directly to the FMCD Department.
  6. Nomination of Dealing Officer from the FMCD Branch Office
  7. Scrutiny by Dealing Officer as Desk Evaluation
  8. Information over the application for queries, if any, over the Communication mail submitted to BIS Department.
  9. Resolution of the Query(ies) raised by the applicant over the mail/hard copy.
  10. Nomination of the Inspection Officer by the Branch Office
  11. Preliminary Inspection by nominated Inspection Officer to verify the details submitted in the application
  12. Sealing of the Samples by BIS to be sent and tested in BIS approved laboratory for Independent Testing
  13. Completion of the Test and Submission of Test Report by the laboratory directly to BIS FMCD Department.
  14. Grant of License, in case the Report is complete and in compliance to the test parameters as per the stated Indian Standard
  15. Agreement of AIR with BIS for the Operation of License
  16. Furnishing “Performance Bank Guarantee” of amount equivalent to USD 10,000 from any Bank having RBI approved Branch in India

  1. Application Fee - INR 1000 (in equivalent USD)
  2. Per Diem Expenses - USD 900 for ASEAN Countries and USD 1200 for others
  3. Charges for the Visit - INR 7000 per day for 6 Mandays (in equivalent USD)
  4. Contingency Funds - INR 10000 (in equivalent USD)
  5. Charges for Airfare, VISA etc - INR 20000 for ASEAN Countries and INR 300000 for others (in equivalent USD)
  6. Advance Minimum Marking Fee - As per Actual
  7. Testing Charges - As per Actual
  8. Annual License Fee - As per Actual
  9. Performance Bank Guarantee - USD 10000 (from any Bank having RBI approved Branch in India)

  1. Prepare the documents as per the stated formats
  2. Submit the details required through hard Copy directly to BIS Headquarter.
  3. Pay the requisite Fee to BIS in INR for SAARC Countries and in USD for others
  4. Wait for the Communication from BIS towards the visit
  5. Preliminary Inspection is conducted by BIS Official
  6. Testing of the sealed Samples by the Concerned Laboratory
  7. Grant of License, on the successful verification of all the details

  1. Company Establishment Legal Documents (such as Certificate of Incorporation, Business License etc.)
  2. Authorised Signatory details such as Contact number, Mail ID, Designation and Authorisation (if required)
  3. Location of the factory from the nearest Airport (Google Coordinates preferred)
  4. Layout Plan of the Factory highlighting major areas such as Office Area, Production Area, Storage Area for Raw Materials and Finished Goods, In-House Testing Laboratory Area etc.
  5. List of complete manufacturing Machinery
  6. List of Raw Material with Supplier’s Information and Test Certificates
  7. Complete In-House Test Equipment details with Calibration Certificates
  8. Complete Manufacturing Process Flow Description
  9. Quality Control Personnel Details such as Appointment Letter, Qualification Certificate, ID Proof, Passport Sized Photograph, Experience (in Years) in the applicant’s Firm
  10. In-House Test Report for the Product as per the Indian Standard Specification
  11. Undertakings and Declarations, if any
  12. Nominated Authorised Indian Representative documents

Renewal of License

  1. Submission of the Documents required through Hard Copy
  2. Submission of Production Data for the Operative Period
  3. Submission of the Consignee Details for the Operative Period
  4. Submission of CA Authenticated Production Data
  5. Pay the Requisite Fee
  6. Grant of Renewal for the Subsequent Year

  1. Preparation of the Documents as required under the stated formats
  2. Submission of the Requisite Documents
  3. Submission of the Fee as per the Production Data
  4. Grant of Renewal of License for the Subsequent Year

  1. Production Data for the Operative Year
  2. Consignee Details for the Operative Year
  3. CA Authenticated Data for the Covered period of Production

Inclusion of New Variety(ies)

  1. Submission of Sample in BIS approved Laboratory for the variety sought under the Inclusion
  2. Receipt of the Test Report from the BIS approved laboratory
  3. Submission of the Requisite Documents through hard Copy (Original)
  4. Pay the Requisite Fee
  5. Scrutiny by BIS Official over the applied variety
  6. Grant of Inclusion on the successful verification of the documents

  1. Submit the Requisite Documents to BIS FMCD Department
  2. Submit the Fee as per the New Variety in USD
  3. Grant of the Inclusion of New Variety covered under the Existing Scope of License

  1. Updated In-House Test Report
  2. Third-Party Test Report
  3. Application for Inclusion
